1. Who we are
These Terms of Service (the "Terms") apply to your use of theswiftcompany.co.uk (the "Site") and to any products you buy from The Swift Company.
The Site is operated by THESWIFTCOMPANY LTD (company number 17228088), whose registered office is at 124 City Road, London, EC1V 2NX, United Kingdom. "The Swift Company", "we", "us" and "our" refer to THESWIFTCOMPANY LTD. "The Swift Company" and our bird logo are trademarks of THESWIFTCOMPANY LTD.
Please read these Terms carefully before ordering. By using the Site or placing an order, you confirm you have read and accept them. If you do not agree, please do not use the Site.
2. Who can buy from us
You must be at least 18 years old to place an order. You confirm that the information you give us (including payment details) is accurate and complete, and that you are authorised to use the payment method you choose.
3. Our products
We sell stainless steel bottles, notebooks and gym wear. We work hard to show colours and details accurately, but how products look on your screen can vary with your device and settings, so slight differences aren't faults.
We reserve the right to change product descriptions, stop selling a product, or limit quantities at any time, and to withdraw or amend promotions and offers at our discretion.
4. Orders and acceptance
When you place an order you are making an offer to buy. Your order is only accepted when we send you an order confirmation email. We may refuse or cancel an order (for example if it appears fraudulent, is a resale order, or if a product is unavailable), and if we do we will tell you and refund anything you have paid for that order.
If we cancel part of an order after payment, we will refund the cancelled items within 14 days.
By placing an order you confirm the products are for your own personal or household use, not for commercial resale.
5. Prices, charges and payment
All prices shown on the Site are in pounds sterling (GBP) and include any applicable taxes. The delivery charge is shown on the product page and in your basket before you pay. Prices can change at any time, but the price in your order confirmation email is the price you pay.
We accept the payment methods shown at checkout. These are major credit and debit cards, Apple Pay, Google Pay, PayPal, Shop Pay and Klarna. Payment is taken when you place your order, except where you choose a Klarna pay-later or instalment option. If your payment is declined or later charged back, we may cancel the order or suspend fulfilment until payment issues are resolved.
Klarna's pay-later and instalment options are provided by Klarna Bank AB (publ), not by us. They are subject to Klarna's own terms, to an eligibility assessment and, where relevant, a credit check, and your agreement for those options is with Klarna. If you return an item you paid for with Klarna, we refund Klarna and Klarna updates your plan in line with your agreement with them.
Offers, discounts and promotion codes are subject to the terms shown with each offer. Only one offer or code can be used per order unless stated otherwise. Our 10% "welcome" code applies to your first order only.
6. Delivery and risk
Products are delivered by Royal Mail within the UK only. Dispatch takes 1-2 business days after we accept your order, and UK delivery normally takes 1-2 business days after dispatch, so most UK orders arrive within 2-4 business days of being placed. These timescales are estimates, not guarantees, and may be longer during busy periods.
Delivery options and charges are set out in our Shipping & Delivery Policy, which forms part of these Terms, and the delivery charge is shown before you pay.
Risk in the products passes to you when you, or someone you have asked to take delivery on your behalf, take physical possession of them. Until then the products remain at our risk. We are not liable for delays caused by Royal Mail or events outside our reasonable control, but if your order does not arrive within the timescales in our Shipping & Delivery Policy, contact us and we will investigate and, where appropriate, replace or refund it.
7. Returns, exchanges and your legal rights
You can return or exchange products within 30 days of the day you receive them, under our Refund Policy, which forms part of these Terms. Items must be unused and unworn, in their original condition, with any labels still attached and in their original packaging.
Two things sit outside that condition, because they are your legal rights and nothing in these Terms can take them away:
- Cancelling within 14 days. You have the right to cancel most purchases within 14 days of the day you receive them, without giving a reason. You may inspect and try items as you would in a shop, and we will not reduce your refund for doing so. We refund the price you paid plus the standard delivery charge, within 14 days of your cancellation. Our Refund Policy sets out how to cancel, including the cancellation form.
- Faulty, damaged or incorrect goods. Goods must be of satisfactory quality, fit for purpose and as described. If they are not, we will repair, replace or refund them. Under the Consumer Rights Act 2015 you have the short-term right to reject faulty goods for a full refund within 30 days of the day you receive them. After that, and within 6 months, you can ask us to repair or replace them; if that is not possible, or does not resolve the problem, you can claim a refund or a price reduction. Faulty items are presumed to have been faulty at delivery if you report them within 6 months. Where an item is faulty, damaged or incorrect, we pay the return postage and refund the original delivery charge you paid.
For all other returns, you pay the cost of sending the item back to us. We recommend using a tracked service, as items are your responsibility until they reach us.
Nothing in these Terms or our policies affects your statutory rights as a consumer under UK law.
8. Intellectual property
The content of the Site — including text, images, product photographs, the "The Swift Company" name and our bird logo — is owned by or licensed to THESWIFTCOMPANY LTD and is protected by copyright and trade mark law. You may not copy, reproduce, or use our content, name or logo without our written permission. This does not affect your right to use the products you buy from us.
9. Third-party links, tools and apps
The Site may include links to third-party websites and use third-party apps (for example for reviews, live chat and promotions). We are not responsible for third-party sites or services, and their own terms and privacy policies apply. We are not liable for any loss caused by your dealings with them.
10. Acceptable use
You agree not to misuse the Site, including by attempting to interfere with it (for example hacking, introducing malware, or scraping content at scale), using it for unlawful activity, or impersonating us or anyone else.
11. Feedback
If you send us ideas or feedback, you agree we may use them freely, without obligation to you. Any personal data in feedback is handled under our Privacy Policy.
12. Errors
Occasionally information on the Site (for example prices, descriptions or availability) may contain errors. We may correct errors and, where a price is obviously wrong, we may cancel the affected order and refund anything paid, telling you what happened.
13. Our liability
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or for breach of your statutory rights under the Consumer Rights Act 2015.
To the fullest extent permitted by law, we are not liable for indirect or consequential losses (such as loss of profits or data) arising from your use of the Site or from any product you buy, other than losses that a reasonable person would expect to flow from our breach.
14. Termination
We may suspend or end your access to the Site if you breach these Terms. Any rights or obligations that should survive termination (for example payment of outstanding amounts and the sections on liability and governing law) will continue to apply.
15. Severability
If any part of these Terms is found to be invalid or unenforceable, that part will be removed and the rest of the Terms remain in full force.
16. Changes to these Terms
We may update these Terms from time to time. The version on the Site at the time you place your order is the one that applies to that order. We will update the "Last updated" date above when we change them.
17. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, except where you are a consumer in another part of the UK, in which case you also benefit from the mandatory consumer protections of where you live.
18. Contact and complaints
Questions about these Terms or your order: hello@theswiftcompany.co.uk.
If something goes wrong, please contact us first — we aim to resolve every issue quickly and fairly. If you are not satisfied with our response, you can get free advice about your consumer rights from Citizens Advice (citizensadvice.org.uk), or contact the Information Commissioner's Office (ico.org.uk) about how we handle your personal data.
